Magistrate tells accused: ‘Bring the law’

An accused man has been instructed to present evidence of a law supporting his claim that court cases must be dismissed if a file is not submitted within six months.

Leighton Greaves made the argument before the No. 2 District ‘A’ Magistrates’ Court after the prosecutor once again objected to his release on bail.

Greaves, who has been on remand for seven months, argued that it was time for the matter to be dismissed, telling the court: “The prosecution has not presented any file or any disclosures…. The law says that if a file has not been produced in six months, the case has to be dismissed.”

Magistrate Manila Renee responded, “Bring the law and show me, because I do not know anything about that law. I would not want to be breaking it, so when you return to court, bring it and show me.”

Greaves further contended that he was being victimised because of his 48 prior convictions, “which I have already paid for”.

However, the magistrate clarified that the reason for his remand was that he was already on bail for another matter when the current charges were laid.

Greaves has denied that on January 11, he unlawfully entered the premises of Fransra Trimmingham, having been forbidden to do so by the occupier; that on January 22, he damaged a motor car belonging to Grace Price; that the following day, he damaged Price’s house; that on February 24, he used the threatening words “I gine ******** kill you towards Gloria Greaves, with intent to cause her to believe immediate violence would be used against her; and that on February 26, without lawful excuse, he damaged a window belonging to CRS Building and Maintenance Incorporated.

His bail was denied, and he returned to the custody of prison officers.

The matters will resume on September 9.
