Joe’s River right-of-way dispute heads to trial

A years-long dispute between residents of Joe’s River, St Joseph, and a private developer over access to one of the area’s best-known natural sites is set to reach the High Court next month.

Three days starting November 10 have been set aside for a trial to determine the final outcome of the controversy, which has been ongoing for several years.

The impasse centres on Ullswater Investments Limited’s construction of concrete columns, which residents say will impede their access to key areas in the community, including the river and the Teacup and Saucer lookout point that the construction has threatened.

The trial will hear testimony from residents and the developer, Richard Hains.

More than 20 residents and others from Bathsheba have filed witness statements in support of their claim of a prescriptive right-of-way to Joe’s River and the Teacup and Saucer.  (EJ)
