Six remanded on robbery, burglary charges

Forty-four charges, the majority of which were for robbery and burglary, were read to six accused when they appeared in the No. 1 District ‘A’ Magistrates’ Court on Tuesday afternoon.

Deroy Leroy Holder, 45, of Patricia Gardens, Mullins, St Peter; Serrian Jamali Scott-Fagen, 20, of no fixed place of abode; Dakari Deshawn Carmichael, 18, of Gunsite Road, Brittons Hill, St Michael; Runako Jeremiah Nurse of 17, of Applegrove, Black Rock, St Michael; and 16-year-olds Tyreall Jamar Kidd, of no fixed place of abode and Damon Hayden Cummins of 2nd Avenue Birds River, Deacons St Michael were not required to plead to the charges which were all indictable.

In the District ‘E’ Holetown jurisdiction, Cummins, Kidd and Scott-Fagen are accused that they:

• Robbed Shawn Jordan of a wallet and contents with a total value of $1 860 on August 30

• Robbed John Gilturo of a bag valued at $200 on August 30

• Entered the building known as Jack’s Pizza as trespassers and stole cash and bottles of whiskey and liquor totalling $1 740 belonging to Jackson Anthony, and at the time had a firearm, a weapon of offence, on August 30

• Robbed Fitzgerald Harvey of $332 cash on August 30

• Robbed Hazel Smith of a handbag and its contents totalling $1 810 on September 1

• Robbed Jahrin Turney of a haversack, cell phone and wallet totalling $1 070 on September 1

• Robbed Stacia Callender of a purse, cell phone and cash with a total value of $1 480 on September 1

• Robbed Portia Scantlebury of a bag, headphones and other contents with a total value of $301 on September 1

• Robbed Trey Messiah of $2 670 belonging to Akedo Limited on September 1

• Robbed Andrea Hope-Pritchard of a cell phone worth $300 on September 1

• Robbed Gabriel Medford of a cell phone, glasses, and cash totalling $1 200 on September 1

• Robbed Darryl Bassaw of a gold chain valued $4 000 on September 1

Meanwhile, Kidd is solely accused of the following offences:

• Robbing Mitchell Trotman of a chain valued at $3 000 on August 16

• Using a firearm without a valid licence on the same date.

Cummins and Scott Fagen are jointly charged that they on August 14:

• Robbed Nikos Ifill of a $1 500 cell phone

• Robbed Otha Holder of a $480  cell phone

• Robbed Jayden Blackett of a $3 000 cell phone

• Robbed Akiel Turton of a $350 cell phone

Cummins is jointly charged with Nurse that on August 12 they:

• Assaulted Henderson Seale with the intent to rob him

• Robbed Traquon Sealy of a wallet and its contents, totalling $205

• Robbed Selwyn Butcher of wallet, wedding band and $450 cash, with a total value of $750

• Robbed Ricardo Orville Best of a wallet and cash totalling $350.

In the District ‘D’ jurisdiction, Holder, Scott-Fagen and Kidd are accused that on August 21 they robbed Anthony Springer of a chain and key valued at $3 000, Steven Phillips of $850 cash and Ajani Small of a cell phone and case totalling $600, while Scott-Fagen, Kidd and Cummins are jointly charged of robbing Marguerite Bellamy of a bangle valued at $20 000 on August 30.

Scott-Fagen, Kidd, and Cummins are also accused in the District E jurisdiction of handling stolen property, namely a motor vehicle belonging to Natasha Cumberbatch, valued at $ 5 000, on September 1.

Four of the accused are also charged with a number of District ‘A’ matters.

Cummins and Scott-Fagen are charged that on August 1, they:

• Robbed Ken Weekes of a wallet and contents totalling $819.80

• Robbed Emerson Carrington of a ring valued at $2 400

• Robbed Ken Durant of a cell phone, cash and a chain with a total value of $2 425

• Robbed Rodney Williams of a cell phone valued at $3 000

• Robbed Dionne Pilgrim of four keys and cash, totalling
$1 005

Cummins and Kidd are charged with assaulting Mencea King with intent to rob on August 16.

Scott-Fagen, Cummins and Kidd are accused that on September 1, they unlawfully assaulted Janice Husbands and entered the building known as Unity Sports Bar and stole whiskey, cosmetic cases, chargers, a ring, purse cash, a cash tin and other items belonging to Husbands and at the time had a firearm.

Cummins is solely charged with assaulting Jason Gibson, occasioning him actual bodily harm on August 1, entering Regal Furniture Manufacturing as a trespasser and stealing an electric screw driver and cash, with a total value of $650 belonging to Emerson Joseph on August 11, stealing a haversack and contents belonging to Andrew Springer and cash belonging to Massy Distribution all totalling $1 834 on August 14, robbing Wendell Medford of $800 and Seymour Layne of $70 on August 18, and stealing a chain valued at $1 800 belonging to Leo Parris on August 19.

Cummins and Carmichael are accused of entering Sticker and Sandra’s Bar as trespassers on August 26 and stealing a chain and pendant valued $4 315 belonging to Sandra Jordan and at the time they were armed with a cutlass. They are also charged that on the same day they entered Dora’s Variety and stole a cash register and cash with a total value of $850, while armed with a cutlass.

Nurse is also separately charged with entering the Carlton Cricket Club and stealing a $1 900 television on August 22.

Prosecutor Station Sergeant Crishna Williams objected to the accused’s release telling the court that Cummins, Scott-Fagen and Holder were known, as they were currently on bail and have found themselves back before the law courts.

She stressed that there was a need to safeguard society, insisting that their release would not be in the interest of public order, public safety or public security.

“The prosecution is of the view that there has been an uptick in the number of robberies and burglaries that have been happening, and these accused would have contributed to that prevalence. We are looking at the strength of the evidence in relation to the matters, as in some instances identification could be made. We are of the view that these men would have caused a lot of terror in society moving from place to place and we cannot have that peace and tranquillity that most Bajans are accustomed to undermined with the behaviour that these men would have allegedly had,” she said.

Defence Attorney Shadia Simpson represented Kidd and held papers for Holder’s legal counsel, Dave Porter, while counsel Johnell King appeared for Carmichael.

Mitigating on his own behalf, Scott-Fagen told the court that “I deserve bail like anybody else” claiming that “Police always looking to put things on me,” while Nurse said that he would like to return home to help his mother and siblings and to continue at Skills Training.

Cummins stated, “I would like some bail. I intend to turn my life around.”

Chief Magistrate Ian Weekes agreed with the prosecution and remanded the men.

“These matters, gentlemen, are very serious matters. They speak to various jurisdictions. These matters speak to 166 square miles of island — not Jamaica, not Trinidad, but a very small island. The citizenry must feel safe and secure. This new Bail Act and I agree that it puts on the judicial officer to maintain the necessary balance. I think I like the sense of peace and security, which should not be undermined, and I believe, because of the range of offences that we have for different individuals, that peace and security must be kept intact. All the gentlemen will be remanded into custody,” he said.

The District ‘A’ matters were transferred to the No. 2 Court and adjourned until October 21.

Meanwhile, the accused will appear in District ‘D’ on October 9 and District ‘E’ on October 28.
