Two teenagers have been granted bail on an unlawful violence charge, while their 21-year-old co-accused remains on remand at Dodds Prison.
Kris Omari Graham and Jacarie Ricardo Kellman, 18, both of Clinketts, St Lucy; and a 16-year-old are jointly charged with using unlawful violence towards Davonte Morris, with their conduct allegedly causing another person present to fear for his personal safety.
The offence allegedly occurred on August 11.
Prosecutor Sergeant Kenmore Phillips again objected to bail, saying there was an ongoing feud between the communities in which the accused and the complainant lived. He stressed that the judiciary’s aim was to protect all people.
He said: “There is the fear that if granted bail and the accused and the complainant see one another, there may be an issue between them, so we need to protect the complainant, the accused and the wider society. A cooling off period is needed.”
Attorney Kyle Walkes, who represented the 16-year-old, and lawyer Iwan Cuffy-Sargeant, who represented Kellman, both urged the court to consider bail.
Overruling the prosecution’s objections, Magistrate Manila Renee granted the 16-year-old and Kellman bail of $5 000 each, with sureties, and ordered them to report weekly to a police station.
She remanded Graham to prison and adjourned the case until September 29, when all three will reappear in the No. 2 District ‘A’ Magistrates’ Court.
