Two brothers are scheduled to return to the No. 1 District ‘A’ Magistrates’ Court on Thursday before Chief Magistrate Ian Weekes, after one pleaded guilty to assaulting the other in a dispute over loud music.
Dwayne Naytaan Fields, 42, of Chapman Lane, St Michael, admitted to assaulting his brother, Jameson Fields, causing actual bodily harm on July 12.
According to Prosecutor Sergeant St Clair Philips, the brothers live together. On the morning of the incident around 7:20 a.m., the accused and his girlfriend were in his bedroom while the complainant was in the shower, playing music on his cell phone. The complainant felt a sudden blow to the back of his head and when he turned around, he saw the accused, who told him that the music was too loud and was preventing him from sleeping. The altercation escalated into a fight, during which the complainant received several slaps and blows to his face, around the left eye and the back of his head. The accused’s girlfriend intervened and separated the brothers.
The complainant reported the matter to the police. His medical report form showed that he was treated for soft tissue damage to the left orbital and occipital region. The accused was treated for a small cut to his hand.
The accused disputed parts of the account, saying that he had asked his brother to stop “bumming” down the house.
“He was hitting up the house while playing the music, and I tell he stop cause he wake me up. We got into a physical altercation, and I end up slapping him three times with the palm of my hand, and that is how I got the mark in my hand,” the accused stated.
Chief Magistrate Weekes said he wanted to speak with the complainant and adjourned the matter until July 17, releasing Fields on $ 2 000 bail.
